What is protected?

The University of Texas at Dallas (“UTD” or the “University”) is committed to creating an accessible and inclusive environment for pregnant and parenting students.

Discrimination based on sex is prohibited in education programs or activities including academic, educational, extracurricular, athletic, and other programs or activities of schools. This prohibition includes discrimination against pregnant and pregnancy-related conditions, such as pregnancy, prenatal doctor appointments, childbirth, false pregnancy, miscarriage, termination of pregnancy, or recovery from any of these conditions. Harassment based on a student’s pregnancy, pregnancy-related condition, or breastfeeding is also prohibited. Some examples of conduct related to pregnancy or parenting status that may amount to harassment include:

  • Sexual comments or denigrating jokes about a pregnancy;
  • Comments about an individual’s intellectual commitment to their education or future profession based on their pregnancy or parenting status;
  • Spreading rumors about sexual activity; or
  • Withholding or threatening to withhold academic benefits due to pregnancy or parenting status.

Faculty, staff and other University employees are prohibited from retaliating against students for exercising the rights articulated by by UTDBP3121 (Student Pregnancy and Parenting Nondiscrimination Policy), UTDBP3090 (Nondiscrimination), UTDBP3102 (Sexual Misconduct Policy), and UTDBP3100 (Policy for Reasonable Accommodations).

How do accommodations work for pregnancy or pregnancy-related conditions?

Students may request accommodations based on general pregnancy needs or accommodations based on a pregnancy-related condition. Accommodations are handled on a case-by-case basis and depend on medical need and academic requirements. Are there lactation spaces available on campus?

The University provides access to lactation rooms for students who wish to express breast milk on campus and provides reasonable flexibility for students to meet their lactation needs. The public listing of lactation spaces is available at the LilyPad map locations and in UTD’s Pregnancy and Parenting Resources Guide.

Can a student take a leave of absence due to pregnancy or pregnancy-related conditions?

For reasons relating to a student’s pregnancy, childbirth, or any resulting medical status or condition, a student may take an academic leave of absence, and if in good academic standing, may return to their degree or certificate program without being required to reapply for admission. A pregnant or parenting student, however, is not required (due to their pregnant or parenting status) to take a leave of absence, withdraw from their degree or certificate program, limit their studies, participate in an alternative program, change their major or degree, or refrain from joining or cease participating in any course, activity, or program at the institution.

Additionally, a pregnant or parenting student, for reasons relating to their pregnancy, childbirth, or any resulting medical status or condition, may take excused absences, make up missed assignments or assessments, have additional time to complete assignments in the same manner as UTD allows for a student with a temporary medical condition, and have access to instructional materials and video lecture recordings for classes for which the student has an excused absence to the same extent that instructional materials and video recordings of lectures are made available to any other student with an excused absence.

In addition to the resources provided above, students may be eligible to receive additional pregnancy and parenting-related protections and resources. For more information about available support and resources, pregnant and parenting students are encouraged to complete the Pregnant and Parenting Self-Identification Form. Submitting this form allows for a coordinated University effort to help facilitate support for pregnant and parenting students, such as early registration for parenting students and accommodations for pregnant students.

Also, parenting students have access to a University Parenting Student Liaison, who can provide parenting students information regarding support services and other available resources. For more information, contact the Title IX Coordinator at TitleIXCoordinator@utdallas.edu.
