Reporting Resources

Overview

The Office of Institutional Compliance is responsible for providing guidance, support, assessment, and investigation for issues that may affect institutional compliance with regulatory obligations, which includes responding to reports and investigating complaints of non-compliant condition, activity, or conduct under the following areas.

  • Allegations of discrimination or harassment (under UTDBP3090) and sexual misconduct (under UTDBP3102), including related retaliation under each respective policy.
  • Suspected noncompliance, unethical behavior, and unlawful retaliation (under UTDBP3105).
  • Incidents involving university-sanctioned programs, activities, camps, and events for minors (under UTDSP5015).
  • Barriers to equal access, commonly referred to as accessibility barriers (under UTDBP3100).

What is Reporting?

Reporting is a way to alert the institution of incidents occurring in the campus community that may need to be addressed. Unlike a complaint:

  • A report may be submitted by anyone regardless of whether they experienced prohibited conduct. -and-
  • Submission of a report does not automatically initiate a grievance process (i.e., complaint resolution procedure) under an applicable policy.

More information about the reporting mechanisms for each policy area is provided below.

Reporting to Institutional Compliance

Discrimination and Sexual Misconduct

Required Reporting:

  • You are a responsible employee (under UTDBP3102) reporting alleged sexual misconduct that someone else experienced. -or-
  • You are a university official, administrator, or supervisor (under UTDBP3090) reporting alleged discrimination that someone else experienced.

Optional Reporting:

  • You are a third party reporting that someone else may have experienced discrimination or sexual misconduct. -or-
  • You are reporting that you have experienced discrimination or sexual misconduct and are unsure if you want to initiate a grievance process but are interested in learning about resolution options and supportive resources.

How to Report:

Non-compliant, Unethical, or Fraudulent Activity

Encouraged Reporting:

  • You are a university employee reporting suspected non-compliant, unethical, or fraudulent activity.

Optional Reporting:

  • You are a non-employee member of our campus community or third party reporting suspected non-compliant, unethical, or fraudulent activity.

How to Report:

  • Please contact the Ethics and Compliance Hotline to report suspected non-compliant, unethical, or fraudulent activity and related university policy violations.
    • Please note the hotline is not a complaint line. Only matters involving noncompliance, unethical, or fraudulent behavior will be investigated, (which includes reports of noncompliance with Texas Education Code 51.3525 – Regarding Diversity, Equity, and Inclusion Initiatives). Individuals who submit grievances will be advised to pursue the normal administrative channels.
Youth Protection (PACE)

Required Reporting:

  • You are a Designated Individual (under UTDSP5015) reporting emergencies or suspected crimes occurring during university sanctioned PACE. -or-
  • You are a Designated Individual (under UTDSP5015) reporting non-emergency incidents occurring during university sanctioned PACE.

How to Report:

  • All emergencies or suspected crimes should be reported immediately by calling 911, followed by a call to the Youth Protection Program at 972-883-2302.
  • All non-emergency incidents must also be promptly reported to the Youth Protection Official in accordance with the procedures established by this office.
  • Please submit a Youth Protection PACE Incident Report Form to report all incidents of illness, medical accident/injury, early departure, and camp rule violations.

Accessibility Barriers

Accessibility barriers are conditions or obstacles that prevent individuals with disabilities from using or accessing information and resources as effectively as individuals without disabilities.

Encouraged Reporting:

  • You are reporting a physical, electronic, or programmatic barrier on campus, such as an inoperative elevator, an inaccessible website, a blocked access ramp, or any other access barrier you may have encountered or observed.

How to Report:

Reporting to UTD Police Department

Campus Security Authority (CSA)/Clery Reporting

A Campus Security Authority (CSA) is an individual, who by virtue of their university responsibilities and under the Clery Act, is designated to receive and report criminal incidents to the UTD Police Department (UTDPD) for inclusion in the University’s Annual Security Report.

Required Reporting:

  • You are a campus security authority (CSA) (under UTDBP3112) reporting criminal incidents to the UTDPD.

How to Report:

The Annual Security Report may be accessed under the Public Information Tab on the UTDPD’s website.

Criminal Reporting and Safety Services

Contact the UTD Police Department (UTDPD) for criminal reporting, information regarding protective orders or forensic sexual assault exams, or to request a police escort.

External Agencies

Discrimination and Sexual Misconduct

U.S. Department of Education – Office for Civil Rights (OCR)

Responsible for enforcing federal laws that prohibit discrimination on the basis of race, color, national origin, sex, disability, or age in programs and activities that receive federal financial assistance.

U.S. Department of Labor – Office of Federal Contract Compliance Programs (OFCCP)

Responsible for enforcing federal laws requiring federal contractors and subcontractors to take affirmative action and not discriminate against job applicants and employees on the basis of race, color, sex, sexual orientation, gender identity, religion, national origin, disability, or status as a protected veteran.

U.S. Equal Employment Opportunity Commission (EEOC)

Responsible for enforcing federal laws that prohibit discrimination against job applicants and employees on the basis of race, color, religion, sex (including pregnancy, gender identity, and sexual orientation), national origin, age (40 or older), disability, or genetic information.

Texas Workforce Commission – Civil Rights Division (TWC)

Responsible for enforcing state laws that prohibit discrimination against job applicants and employees on the basis of race, color, national origin, religion, sex, age, or disability.

Fraud, Waste, or Abuse

The Texas State Auditor’s Office investigates allegations of illegal acts and improprieties involving any entity that receives funds from the state. The fraud hotline provides resources for individuals to report such allegations.

Suspected Child Abuse or Neglect

Texas law requires anyone with knowledge of suspected child abuse or neglect to immediately report it to the Department of Family and Protective Services (DFPS). Reports can be made at any time to DFPS by phone at 800-252-5400 or online at Texas Abuse Hotline.
